NRI paying for parents overseas holiday: TCS questions before paying an Indian travel company

Separate buyer, traveller and payer; check the current package-sale rate, nonresident evidence, tax identity, certificate and cancellation questions before payment.

Before an NRI child pays an Indian travel company for parents' overseas holiday, settle three roles in writing: who buys the package, who travels and who sends the money. Do not assume that a foreign card, an overseas address or the word “NRI” on a WhatsApp message determines the TCS treatment.

Checked 4 November 2026: the Finance Act 2026 changed the ordinary TCS rate for sale of an overseas tour programme package to 2%, irrespective of amount, from 1 April 2026. This is the package-sale provision, not a promise that every payment attracts 2%, or that every NRI is exempt. The seller must establish the transaction and any applicable exception. This article is a question checklist, not an individual tax opinion.

First ask which transaction is being taxed

Ask: “Is this invoice for an overseas tour programme package under section 394(1), Table serial 8, or are you relying on a different provision?” Get the seller's legal name, package components, invoice amount, payment schedule and tax calculation separately. Do not confuse the package-sale provision with a bank's treatment of a remittance under the Liberalised Remittance Scheme, which has a separate table entry.

The final Finance Act 2026, section 85(f), replaces both old rate clauses for table serial 8 with 2%. Some older guidance still displays 5% up to ₹10 lakh and 20% above. Those are not the current ordinary package-sale rate for a transaction covered by the amended provision. If a quote uses an older slab, ask for the dated legal basis and relevant transaction date before accepting it. Do not apply today's rate retrospectively to an earlier collection without advice.

Who is the buyer when the child pays?

Section 402(6) describes the buyer for the package-sale provision as the person who purchases the overseas tour programme package, subject to exclusions. A payment source alone does not settle that identity. Ask the seller to state who the contract and invoice identify as buyer, who the travellers are and whose tax identity will be used if TCS is collected.

For example, a child sending money for an invoice bought by a parent and a child buying a package in their own name for travelling parents are not facts to silently treat as identical. Have the seller and, where needed, your tax adviser assess the actual arrangement. Never change the buyer's name merely to obtain a preferred tax result.

If you claim nonresident treatment, ask for the exact basis

A secondary reproduction of CBDT Notification 99/2022, dated 17 August 2022, describes an exclusion for a buyer who is nonresident under the old Act's section 6 and has no permanent establishment in India. It superseded the narrower March 2022 notification. We did not independently retrieve that notification from an official host during this check. Its current application to a child buying for resident parents is therefore unconfirmed in this guide; do not use this paragraph as an exemption certificate.

The 2025 Act's section 536(2)(j) preserves old notifications only so far as consistent with corresponding new provisions. That general saving does not by itself decide your buyer identity, residency or current eligibility. Ask the seller for the official notification, current provision mapping, evidence it needs and its written conclusion before payment. A bank's NRI account label is not a substitute for that assessment. If unresolved, obtain a tax adviser's view rather than assuming either exemption or automatic collection.

Agree the paperwork before money moves

  • Calculation: request the amount to be paid, separate TCS line, rate, calculation base, collection date and legal basis for any variation or exception.
  • Tax identity: ask whose PAN or other permitted identifier the seller requires and why. Do not casually use a parent's PAN simply because the parent travels, or the child's merely because the child pays.
  • Evidence: ask what minimum documents or declarations are needed and send them through the seller's verified private route. Do not post passport, PAN, bank details or residency documents in an open travel group.
  • Certificate and correction: section 395(4) provides for a certificate specifying the tax amount, rate and prescribed particulars. Ask how and when the seller will issue the applicable certificate and how an incorrect buyer or tax-identity record will be corrected.
  • Cancellation: ask separately what happens to the package refund and any tax already collected or reported. Do not assume the travel company's cancellation refund automatically reverses the tax record or creates an immediate cash refund.

Keep a single family payment file

Save the accepted quote, named buyer and travellers, written tax explanation, invoice, payment reference, certificate and any unresolved follow-up. Ask your adviser who can claim any tax credit and what filing or correction is needed for that person's actual position. This guide promises no refund amount, processing time, credit transfer between family members or exemption.

TripKeeper's planning role is to keep the travel purchase and family handover clear: package scope, buyer, payer, parents' itinerary and the person following up. Tax treatment needs the seller's documented basis and, where uncertain, qualified advice. There is no destination trip card here because this checklist is not destination-specific.

Questions on this article

asked by readers, answered by us

Is every NRI payment exempt from TCS?

Do not assume so. Establish the actual buyer, residency and current official basis for any exception. Application of Notification 99/2022 to the family transaction remains unconfirmed in this guide.

What is the ordinary current overseas-package rate?

Finance Act 2026 section 85(f) replaced the old rate clauses in section 394(1), Table serial 8 with 2%, effective 1 April 2026. This does not settle every payment's applicability or exemption.

Does paying make the child the buyer?

A payment source alone does not decide the buyer. Clarify the contract and invoice purchaser, travellers and tax identity with the seller in writing.

Whose tax identity should be used?

Ask the seller to explain the actual buyer and tax-reporting basis. Do not choose a parent's PAN just because they travel or the child's merely because they pay.

Does trip cancellation mean an immediate TCS refund?

Do not assume that. Ask separately about the travel refund and correction or refund of already collected or reported tax. No immediate cash refund or processing time is promised.

What should I do if the tax position is unclear?

Before payment, obtain the current provision, official notification, evidence requirements and written conclusion. If unresolved, get qualified tax advice on the actual arrangement.
